1. Publisher and hosting
The ruly website and app are published by atech, a sole proprietorship, SIRET number 931 848 618 00019, based in France, which is also the publishing director. Contact: atech.contact@proton.me.
They are hosted by Firebase Hosting, a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4 (Ireland), phone +353 1 543 1000.
2. Purpose
ruly is an online decision support tool for individual investors. These terms govern the use of the website and the app, and the subscription to the paid plan. They apply as soon as an account is created.
3. Nature of the service
The user chooses criteria and thresholds, or starts from a template, then enters a company’s figures themselves. The service applies those thresholds to those figures and shows a result per criterion, a verdict (“Criteria met” or “Criteria not met”), a score and the dated history of the sheets.
ruly is a decision support tool. It is neither investment advice nor an investment service. It provides no market data, no analysis of any security and no opinion on whether any transaction is appropriate. Its results only apply the user’s criteria to the figures they entered. The verdict “Criteria met” only means that those figures meet those thresholds. The decision to invest and its consequences remain the user’s own.
4. Risk warning
Investing in financial markets involves risks, including the loss of all or part of the capital invested. The value of a share or a fund can go down as well as up. Past performance is not a reliable indicator of future performance. No strategy, no score and no threshold protects against a loss.
ruly provides no prices and no company accounts, asks for no investor profile and does not take the user’s situation into account. It manages no portfolio and transmits no orders.
Before investing, check your figures at the source, in companies’ annual reports. Only invest amounts whose loss would not put your situation at risk, and spread your risks. If needed, consult a licensed financial adviser in your country.
5. Account
The app is used with an account, created with an email address. The user is of legal age, provides an accurate address and keeps their credentials confidential. They are responsible for the activity on their account. An account is personal and may not be shared.
6. Figures entered by the user
The figures entered in the sheets (financial data, prices, notes) are chosen and entered by the user, under their sole responsibility. atech does not check them and is not liable for their accuracy, for keeping them up to date, or for results calculated from incorrect figures. Public sources that the website may mention remain outside the service.
7. Templates
Templates are ready-to-use strategies, presented as examples that can be edited. They illustrate an approach. They are neither a selection of securities, nor a method with an assured outcome, nor an incentive to invest. No return is promised.
8. Free plan
The free plan gives access to strategies, templates, results, the score and the dashboard, up to 3 sheets and without the history of frozen versions. It is available from every country, with no payment method required.
9. Paid plan, price and payment
The paid plan removes the limit on the number of sheets and unlocks the history of frozen versions. It is taken out as an annual or monthly subscription, at the price shown including all taxes on the website and at checkout. As long as atech benefits from the VAT exemption for small businesses, VAT is not applicable.
Payment is processed by Stripe. atech neither receives nor stores card or bank account details. The contract is concluded when payment is confirmed.
The paid plan is not offered in every country. A subscription taken out from a country where it is not offered is cancelled and refunded.
The price may change. The current price is always shown on the website, and subscribers are invited to check it regularly. A new price only applies from the next renewal date. A subscriber who does not accept it may cancel before that date.
10. Term and renewal
The subscription runs for one year or one month, depending on the option chosen. It renews automatically for the same term, at the price then in force, unless cancelled.
11. Cancellation by the subscriber
The subscriber may cancel at any time, at no cost and without giving a reason, in three clicks: the “My account” page of the app, the cancel button, then confirmation in the Stripe payment portal.
Cancellation takes effect at the end of the period already paid. Access to the paid plan stays open until that date, with no prorated refund. The account then returns to the free plan: no sheet is deleted, and those beyond the limit become read-only.
12. Right of withdrawal
Consumers normally have 14 days to withdraw from a contract concluded at a distance. The paid plan gives access to digital content not supplied on a tangible medium, whose performance begins as soon as payment is confirmed. At checkout, the subscriber requests this immediate performance and expressly waives their right of withdrawal by ticking a box provided for that purpose. The right of withdrawal can then no longer be exercised.
No refund is therefore due, neither for the current period nor on a prorated basis. The subscriber remains free to cancel at any time (article 11), with access open until the end of the paid period.
13. Availability and changes to the service
The service is available continuously, except during maintenance, outages or force majeure. atech may change it. A change that removes an essential feature of the paid plan allows the subscriber to cancel, with a refund of the unused period.
14. Intellectual property
The website, the app, their code, texts, visuals and design are the property of atech, unless stated otherwise. Any reproduction without prior permission is prohibited. The subscription grants a personal, non-exclusive and non-transferable right of use. The strategies, sheets and figures entered by the user belong to them.
15. Prohibited use
In particular, the user agrees not to:
- get around the limits of the free plan or the protections of the service
- access the service by automated means without permission
- resell or redistribute the service
- use it for any unlawful purpose
16. Conformity of the service
atech supplies a service that conforms to the contract for its whole duration, subscription included. Consumers keep the rights that the law gives them when a digital service does not conform to the contract.
17. Liability
atech is not liable for the user’s investment decisions and their consequences, including capital losses, nor for the figures they entered (article 6). This exclusion does not limit the rights that consumers derive from the legal rules on conformity of the service (article 16) and other mandatory rules.
18. Suspension or closure of the account by the publisher
In the event of a serious breach of these terms, atech may suspend or close the account, after a formal notice by email that has remained without effect for 15 days, except in an emergency or in the case of unlawful use. A closure for breach does not give rise to any refund.
19. Personal data and account deletion
The processing of personal data, and how to delete the account and all its data from the app, are described in the privacy policy.
20. Complaints
Complaints are sent in writing to the publisher, at the contact address given in article 1.
21. Governing law, language and disputes
These terms are governed by French law, without depriving consumers of the protection of the mandatory rules of their country of residence. They are written in English.
Failing an amicable settlement, the dispute is brought before the competent courts. Consumers may bring it before the court of their place of residence.
22. Changes to the terms
These terms may be changed. The version in force is the one published on this page, and the date of its last update is shown at the top. Users are invited to consult it regularly. If a clause is found to be void, the others remain applicable.
